AfriBusiness supports SADPO in Constitutional Court

The business rights watchdog AfriBusiness and the South African Diamond Producers Organisation (SADPO) achieved success together in 2016 in the North Gauteng High Court by having the controversial Section 20A of the Diamond Act, 1986 (Act No. 56 of 1986) declared unconstitutional. However, this order needs to be upheld in the Constitutional Court on 11 May 2017.

This controversial section of the Act prohibits license holders from selling unpolished diamonds at any other place than registered South African diamond exchange and export centres. Sections 22 and 25 of the Constitution, which offer protection on the freedom of trade and property right, are of relevance here.
