Property rights in South Africa are under pressure. Not only are the EFF and ANC amending the Consitution to allow for “legal” expropriation without compensation; but, while this is going on, Julius Malema and other radical figures are openly encouraging the illegal occupation of land. In spite of repeated assurances by  President Ramaphosa – that Government will not allow illegal landgrabs – this happened over and over again throughout 2018. There is, unfortunately, reason to believe that land grabs will accelerate in 2019, unless businesspeople and communities have a hand in stopping them.

What is Landgrab911?

Landgrab911 is a platform to help prevent illegal land occupations. It empowers land owners with information, legal assistance and property record from the offices of the Chief Surveyor General, with the purpose of repulsing illegal land invasions, or for making preparations against them.

Where will I get legal assistance?

In the public interest, and also in the interest of the individual, it is necessary to act against land grabs as soon as possible. Such action, however, is costly because it usually is accompanied by legal costs to obtain an urgent interdict. To enable Sakeliga members to act against land grabs, Hurter Spies Attorneys offer members of Sakeliga – who contribute R300 or more per month to Sakeliga – assistance for obtaining an urgent interdict and expulsion order at a reduced rate.

If, in the event of a land occupation, you wish to make use of Hurter Spies’ services, your Landgrab911 information packet will list the steps and contact details you will need for having an assessment done.

Why did Sakeliga build this platform?

The debate on expropriation without compensation is doing a great deal of damage to the South African economy. One way in which this happens is by encouraging illegal land occupation. Illegal land occupation is not limited to agricultural land but often also occurs in urban, including commercial, areas.

One of the major dangers of illegal land occupation is that it is an infectious phenomenon, with spillover effects. If land grabs occur in one part of the country and are not opposed, it encourages land grabs and lawlessness in other parts of the country as well. For this reason, it is in the public interest to repulse any land grabs, wherever they may occur. In this way, the legal order may be protected and the limited resources of the police and private security are protected from being overwhelmed.

Do I need to wait until my land has been occupied? Or is there something I can start doing now?
